Under art. 13, SGE Italia S.r.L. is particularly attentive to aspects regarding privacy.

This document is a general information made in compliance with Legislative Decree no. 196 of June 30, 2003 "Personal Data Protection Code" (ex Leg. 675/1996) for those who visit the website of SGE Italia S.r.L.

Firstly, the legislation at issue provides that whoever processes personal data is required to inform the person concerned by the data processing and regarding certain qualifying elements of the processing, which in any case must be fairly legitimate and transparent, safeguarding confidentiality and all rights. Therefore, in accordance with Art. 13 of Legislative Decree no. 196/2003, we provide the following information.

Nature of processed data

We intend to process personal data regarding persons involved in the processing (personal, fiscal and economic data) that are necessary for contractual relations, whether ongoing or to be held in the future. We do not intend to acquire any data qualifying as sensitive or having a judicial nature pursuant to art. 4, paragraph 1 of Legislative Decree no. 196/2003.

Purpose of treatment

The data regarding the subjects involved in the processing will be processed in relation to contractual requirements and the consequent fulfillment of the legal and fiscal obligations and to enable the effective management of financial and commercial relations. The data will be processed for the duration of contractual relations and subsequently for the fulfillment of legal obligations and for administrative and commercial purposes.

Processing procedure

The data processing for persons to whom the processing refers will take place by means of appropriate tools and procedures to ensure its safety and confidentiality and can be carried out either by means of paper media or electronic instruments.

Obligation or power to submit the data and consequences of possible refusal

As regards the data we are obliged to know in order to comply with the obligations laid down by laws, regulations and Community legislation, or by provisions of the Authority legally authorised by law and by supervisory and control bodies, the failure to submit them will make it impossible to establish or continue relations, insofar as such data are necessary to carry out these relations. Regarding the data we are not obliged to know, we will assess the failure to submit them from time to time, and will determine the resulting decisions based on how important the required data are for us.

Communication and dissemination

We will not ‘disseminate’ the data of the persons to whom the processing refers. This means that we will not make them known to indefinite persons in any way, even by making them available or consultable. However, we can ‘communicate’ them, meaning that we can make them known to one or more specified persons as follows:

  • to persons in charge of data processing within our Company, in particular to the employees of the Administrative Office Sales Office, Technical Office and operating personnel;
  • to persons who can access data under statutory provisions, regulations or Community legislation, within the limits set by these rules;
  • to persons who need to access data for purposes accessory to the relations, within the limits strictly necessary to carry out the accessory tasks entrusted to them (e.g. banks and shippers);
  • to our consultants, within the limits necessary to carry out their duties at our Company, following our letter of appointment imposing the duty of confidentiality and security in data processing.

Rights of the interested parties

This extract from art. 7 of Legislative Decree no. 196/2003 notes that the persons to whom the treatment relates may exercise the following rights towards us:

  • obtain confirmation of the existence of personal data concerning them, even if not yet registered, and the intelligible communication of the data and their origin, as well as the purposes and methods of processing and the method applied in case of processing with electronic instruments;
  • obtain deletion, turning anonymous or blockage of data whose storage is not necessary in relation to the purposes for which the data were collected and processed;
  • obtain updating, rectification and data integration;
  • object, in whole or in part, for legitimate reasons, to the processing of personal data concerning them, even though they are relevant to the purpose of the collection.
